Global Anti-Spam & Electronic Communications Policy

Applies To: MedWise Billing, Inc. and all affiliated brands, platforms, training programs, and websites, including but not limited to MedWiseTraining.com

1. Purpose & Compliance Commitment

MedWise Billing, Inc. (“MedWise,” “we,” “us,” or “our”) is committed to the lawful, ethical, and transparent use of electronic communications worldwide. This Anti-Spam Policy establishes mandatory standards governing the creation, delivery, management, and suppression of electronic messages sent by or on behalf of MedWise.

This Policy is intended to ensure compliance with applicable global anti-spam and data protection laws, including but not limited to:

  • The U.S. CAN-SPAM Act

  • Canada’s Anti-Spam Legislation (CASL)

  • The EU/UK GDPR and ePrivacy Directive

  • Australia’s Spam Act 2003

  • Other applicable national and regional regulations

Where local law imposes stricter requirements than this Policy, the stricter standard shall apply.

2. Scope

This Policy applies to:

  • All Commercial Electronic Messages (“CEMs”) sent by MedWise

  • All MedWise employees, contractors, agents, affiliates, vendors, and service providers

  • All electronic channels, including email, SMS, MMS, messaging platforms, and similar technologies

3. Definitions

3.1 Commercial Electronic Message (CEM)

A Commercial Electronic Message is any electronic communication that, directly or indirectly:

  • Promotes, advertises, or markets a product, service, program, or business opportunity

  • Encourages participation in training, courses, events, or subscriptions

  • Seeks to influence purchasing, enrollment, or commercial behavior

This includes, without limitation, emails, newsletters, promotional messages, onboarding sequences, transactional messages containing promotional content, and automated follow-ups.

3.2 Consent

Consent means a freely given, specific, informed, and unambiguous indication that a recipient agrees to receive CEMs from MedWise.

MedWise requires express opt-in consent as its global standard.

Express consent must:

  • Be obtained prior to sending any CEM

  • Be captured through an affirmative action (e.g., checkbox, form submission)

  • Clearly disclose the nature and purpose of communications

  • Not be pre-checked, bundled, or implied

  • Be documented and retained in compliance records

Implied consent, purchased lists, rented lists, harvested addresses, or scraped data are strictly prohibited.

3.3 Unsubscribe Request

An Unsubscribe Request is any request—explicit or implicit—by a recipient to stop receiving some or all electronic communications from MedWise.

This includes:

  • Clicking an unsubscribe link

  • Replying “STOP,” “UNSUBSCRIBE,” or similar language

  • Emailing a removal request

  • Any other reasonable expression of withdrawal of consent

4. Consent & Opt-In Requirements

MedWise enforces a strict express opt-in only policy.

Accordingly:

  • No CEM may be sent without documented express consent

  • Consent must be specific to MedWise Billing, Inc.

  • Consent must not be transferred, sold, or shared

  • Silence, inactivity, or failure to opt-out does not constitute consent

5. Unsubscribe & Opt-Out Handling

MedWise maintains a zero-friction opt-out policy.

Mandatory Requirements:

  • Every CEM must include a clear, conspicuous unsubscribe mechanism

  • Unsubscribe requests must be honored within 5 business days

  • Opt-out is perpetual unless the recipient later re-opts in

  • Suppressed addresses must never be re-added, re-imported, or re-messaged

  • No login, password, fee, or additional steps may be required to unsubscribe

Once an unsubscribe request is processed, the recipient will be added to a permanent suppression list.

6. Message Integrity & Transparency

All CEMs sent by or on behalf of MedWise must adhere to the following standards:

6.1 Header & Routing Accuracy

  • “From,” “Reply-To,” and routing information must accurately identify MedWise

  • No spoofing, falsification, or obfuscation of sender identity is permitted

6.2 Subject Line Accuracy

  • Subject lines must be truthful and not misleading

  • Subject lines must accurately reflect message content

6.3 Identification & Contact Information

Each CEM must clearly identify MedWise as the sender and include:

  • Legal business name: MedWise Billing, Inc.

  • Physical mailing address: Monroe, NY 10950, United States

  • Valid contact email: adria@medwisetraining.com

7. Prohibited Practices

The following practices are strictly forbidden:

  • Purchased, rented, or third-party email lists

  • Address harvesting or scraping

  • Deceptive routing or masked sender identities

  • False urgency, misleading claims, or bait-and-switch messaging

  • Sending messages after opt-out

  • Re-permissioning campaigns to unsubscribed addresses

Violations may result in immediate termination of access, contracts, or services.

8. Record-Keeping & Audit Trails

MedWise maintains detailed compliance records, including:

  • Date, time, and method of consent capture

  • Source URL or form used for opt-in

  • IP address and timestamp (where applicable)

  • Message delivery logs

  • Unsubscribe and suppression logs

Records are retained for a minimum period consistent with applicable legal requirements and are subject to internal or external audit.

9. Third-Party & Affiliate Communications

MedWise may engage third-party platforms or affiliates to support marketing or communications activities. However:

  • Each third party is solely responsible for its own compliance

  • MedWise does not authorize third parties to send CEMs on its behalf without prior written approval

  • MedWise disclaims liability for unauthorized or non-compliant mailings conducted by third parties

Any authorized partner must contractually agree to meet or exceed this Policy.

10. Enforcement & Consequences

Violations of this Policy may result in:

  • Immediate suspension or termination of access

  • Contract termination

  • Legal action

  • Regulatory reporting where required

MedWise reserves all rights and remedies available under law.

11. Severability

If any provision of this Policy is found unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

12. Choice of Law & Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict-of-law principles.

13. Policy Updates & Revision Log

MedWise reserves the right to modify this Policy at any time to reflect legal, regulatory, or operational changes.

Material updates will be reflected by a revised “Last Revised” date and, where required, communicated to users.
