1. Purpose & Legal Framework

MedWise Billing, Inc. (“MedWise,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of MedWiseTraining.com to do the same.

This DMCA Compliance Policy is adopted in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and establishes procedures for:

  • Submitting copyright infringement notices

  • Processing takedown requests

  • Submitting counter-notifications

  • Maintaining eligibility for DMCA safe harbor protections

2. Designated DMCA Agent

3. Submitting a DMCA Takedown Notice

If you believe that copyrighted material hosted on or accessible through MedWiseTraining.com infringes your copyright, you must submit a written DMCA takedown notice that includes all of the following elements:

  1. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved)

  2. Identification of the allegedly infringing material, including the specific URL(s) or location(s) on MedWiseTraining.com sufficient to allow MedWise to locate the material

  3. Your contact information, including full name, mailing address, telephone number, and email address

  4. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law

  5. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner

  6. Your physical or electronic signature

Incomplete or defective notices may not be processed.

4. Takedown Procedure

Upon receipt of a valid DMCA notice, MedWise will:

  • Promptly review the notice for legal sufficiency

  • Remove or disable access to the allegedly infringing material, where appropriate

  • Take reasonable steps to notify the affected user, if applicable

MedWise reserves the right to remove content at its sole discretion where infringement is apparent.

5. Counter-Notification Process

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification in writing to the Designated DMCA Agent that includes:

  1. Identification of the material that was removed or disabled and its former location

  2. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification

  3. Your name, address, telephone number, and email address

  4. A statement consenting to the jurisdiction of the federal courts located in New York, and that you will accept service of process from the original complaining party

  5. Your physical or electronic signature

Upon receipt of a valid counter-notice, MedWise may forward it to the original complainant and, unless the complainant files an action seeking a court order within the time required by law, may restore the material.

6. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), MedWise maintains a policy to terminate, in appropriate circumstances, the access of users who are determined to be repeat infringers.

MedWise reserves the right to:

  • Track infringement notices associated with specific users

  • Terminate accounts or access without prior notice for repeat violations

  • Deny future access to services or platforms operated by MedWise

7. Safe Harbor Conditions

MedWise’s compliance with this Policy is intended to preserve eligibility for DMCA safe harbor protections. Nothing in this Policy shall be construed as:

  • An admission of liability

  • A waiver of any legal defenses

  • A guarantee that content will be removed or restored in every instance

8. Record Retention

MedWise retains records relating to:

  • DMCA takedown notices

  • Counter-notifications

  • Content removal or restoration actions

Such records are maintained for a commercially reasonable period consistent with legal and compliance obligations.

9. Indemnification Carve-Out

To the fullest extent permitted by law:

  • Any party submitting a DMCA notice or counter-notice agrees to indemnify and hold harmless MedWise Billing, Inc. from any claims, damages, losses, liabilities, or expenses (including attorneys’ fees) arising from misrepresentation or bad-faith assertions under the DMCA

Knowingly submitting false or misleading claims may result in legal liability under 17 U.S.C. § 512(f).

10. Severability

If any provision of this Policy is held to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

11. Governing Law & Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict-of-law principles.

Any dispute arising under this Policy shall be subject to the exclusive jurisdiction of the state or federal courts located in New York.

12. Revision History & Updates

MedWise Billing, Inc. reserves the right to modify this DMCA Compliance Policy at any time.

All changes will be effective upon posting to MedWiseTraining.com and reflected by an updated “Last Revised” date.
